Applicant Is A Woman: MP High Court Grants Anticipatory Bail To Woman Accused Of Developing Unauthorized Colony & Selling Plots
An Application was filed seeking anticipatory bail for the offence punishable under Section 420 of IPC and under Section 292-c of Municipal Corporation Act.

The Madhya Pradesh High Court granted anticipatory bail to a woman accused of developing an unauthorized colony, on account of the gender of the accused.
The Applicant was accused of developing a colony and selling the plots without development permission, without diversion of land or without the sanction of the competent authority.
The Bench of Justice Devnarayan Mishra ordered, “Applicant is directed to cooperate with the investigating agency and shall also appear on the date and time, as directed by the Investigating Officer.”
The Court held, "Looking to the factual aspect and the applicant is a woman, the anticipatory bail application is allowed".
Advocate Kamlesh Singh Rajput represented the Petitioners, while Advocate C.K. Mishra represented the Respondent.

The Applicant contended that a false report was lodged by the Municipal Corporation Authority that an unauthorized colony has been developed by the applicant without taking permission.
While the State contended that the applicant had developed a colony and sold the plots without development permission, without diversion of land or without the sanction of the competent authority. She was a colonizer, hence she was not entitled to get the anticipatory bail.
Court’s Observation
The Court allowed the anticipatory bail application of the woman.
The Court observed, “It is directed that in the event of arrest, the applicant shall be enlarged on bail on furnishing a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like amount to the satisfaction of the Arresting Officer for her appearance before him during the course of investigation or before the trial Court concerned during trial, as the case may be.”
