Terms of Use



Candidlex Advisors LLP (hereinafter “Candidlex”) is the sole and absolute owner of, and maintains and operates the website www.verdictum.in (hereinafter “Verdictum”), contents whereof are made available via mobile phone application, social media, RSS feed and other digital services from time to time. You are required to regularly and carefully read these Terms of Use as well as the Privacy Policy which shall be treated as part of these Terms of Use. By accessing or using contents or services of Verdictum, you confirm your knowledge and acceptance of these Terms of Use and agree to comply with and be bound by the same. Subject to these Terms of Use, Candidlex permits you to access and makes personal non-commercial use of contents and services of Verdictum. Candidlex reserves the right to revise these Terms of Use at any time at its sole discretion by posting revised Terms of Use on Verdictum, without any other or further notice to you.

Proprietary Rights

The contents of Verdictum (“contents” will include but is not limited to trademarks, service marks, logos, brand names, trade names and other distinctive identifications and information, data, texts, materials, interfaces, computer code, databases, products, services, software applications and tools, text, images, photographs, audio and video material, artwork, design, layout, structure, selection, compilation, assembly, coordination, expression, functionalities, applications, and arrangement) contained in or available through Verdictum are the property of Candidlex or its licensors and are protected under Indian laws including laws relating to intellectual property rights. You are prohibited from modifying, publishing, reproducing, transmitting, distributing, performing, displaying in any form, communicating to public, creating derivative works or participating in the transfer or sale of any of the contents in whole or in part except judgments, orders, notifications, circulars and laws, which may be downloaded or copied and used for personal and non-commercial purposes without modifying in any manner any content, watermark, notice or trademark added to it by Verdictum and by giving due credit to Verdictum.

In addition to what is stated above, you warrant and agree that you will not

i. Violate any law while using Verdictum.

ii. Use, upload, post, email, transmit or otherwise make available any content or comment that is untrue, inaccurate, incomplete, unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, invasive of another’s privacy, hateful or otherwise objectionable.

iii. Harm, influence or make inappropriate contact or seek to harm, influence or make inappropriate contact with minors or vulnerable persons in any way.

iv. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content of Verdictum.

v. Impersonate any person or entity, including, official, office bearers of Candidlex, or otherwise misrepresent your affiliation with a person or entity.

vi. Use, upload, post, email, transmit or otherwise make available any content or comment that infringes or passes off or harms or seeks to harm any patent, trademark, service mark, trade secret, brand, copyright or other proprietary rights or personal rights of any party.

vii. Use, upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.

ix. Use, upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, false or fraudulent advertising, spam or any other form of solicitation.

x. Use, upload, post, email, transmit or otherwise make available any content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.

xi. Use, upload, post, email, transmit or otherwise make available any content which threatens the unity, integrity, defence, security and/or sovereignty of India or its boarders, friendly relations with foreign states, or public order or causes incitement to the commission of any offence or prevents investigation of any offence.

Limitation of Liability

Candidlex shall not be liable, at any time for damages (including, without limitation, damages for loss of business projects, loss of savings, loss of revenue, loss or loss of profits) arising in contract, tort or otherwise from the use of or inability to use Verdictum, or any of its contents, or from any act or omissions as a result of using Verdictum or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on Verdictum. No representations, warranties or guarantees whatsoever are made as to the accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation. Candidlex, its subsidiaries, affiliates, directors, partners, shareholders, employees, representatives, advertisers or content providers, shall not be liable to you or anyone else as a result of your access of Verdictum for indirect, special, incidental, punitive or exemplary damages. You agree to indemnify and hold Candidlex, its subsidiaries, affiliates, their directors, partners, shareholders, officers, employees and representatives, harmless from any claim, demand, loss, cost, liability, expenses or damage, including reasonable legal fees and cost of litigation, asserted by any third party due to or arising out or connected with your access/use of Verdictum.

Candidlex does not accept any liability for any link on the Verdictum to any content hosted or maintained by third party and you may access such link entirely at your risk. Candidlex does not endorse or vouch for correctness or accuracy of any such content hosted or maintained by third party.

Please obtain permission from your parent or guardian before you take part in any discussion on any platform of Verdictum. Never reveal any personal information about yourself or anyone else.

Data Protection and Privacy Policy

You are requested to read the Privacy Policy of Candidlex, which is incorporated into and is part of these Terms of Use.

Notwithstanding the aforesaid, Candidlex reserves the right to disclose any information provided by you or collected from you in relation to any governmental, administrative or regulatory proceedings or as may be required under applicable laws.

Termination

Candidlex may, at its sole discretion, terminate or suspend your access to all or part of Verdictum for any reason, including, without limitation, breach of any of the terms of these Terms of Use.

General

Failure or delay in enforcing any provision of these Terms of Use by you shall not in any way constitute a waiver by Candidlex of its right to enforce any terms or conditions of these Terms of Use subsequently. Nothing in Terms of Use shall constitute any partnership or agency relationship between you and Candidlex. If you access or use Verdictum from outside India, you shall do so in compliance with these Terms of Use and the laws of your location, at your own risk.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. In the event of any dispute between the parties, such dispute shall be settled through arbitration by a single arbitrator appointed by Candidlex in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be at Delhi and the language of arbitration shall be English. Any award rendered pursuant to such arbitration shall be final, binding and conclusive.
