While considering a contempt case involving a man who made unfounded allegations against the Judiciary, the Supreme Court has directed the Central Bureau of Investigation to issue a Red Corner Notice through Interpol against him to secure his presence.

It was brought to the High Court’s notice that the respondent last travelled out of the country in August 2024 to Italy, after which he had not returned to India.

The Bench comprising Justice Navin Chawla and Justice Ravinder Dudeja held, “Given the above, we direct the Central Bureau of Investigation to issue a Red Corner Notice through INTERPOL against the respondent for securing his presence in compliance of our orders, including the NBWs.”

Amicus Curiae Amit George represented the Petitioner while Central Govt Standing Counsel Amit Tiwari represented the Union Of India.

Factual Background

The respondent had appeared virtually and again made unfounded allegations. It was brought to the Court’s notice that the present whereabouts of the respondent were not known, and a Look Out Circular was also issued against him.

Reasoning

Taking the aforesaid aspects into consideration, the Bench directed the Central Bureau of Investigation to issue a Red Corner Notice through Interpol against the respondent.

Considering that it was reported that the IP Address from which the respondent joined the Court proceedings was found to belong to Gilroy, California, United States of America, the Bench ordered, “The Ministry of External Affairs is directed to inform the concerned Authorities in USA about the NBWs issued against the respondent by this Court, the expiry of his Indian Passport, and also his IP Address, for making efforts to trace the respondent and produce him before this Court.”

The Bench also asked the Registry to supply details of the IP Address from which the respondent had joined the proceedings to the Additional Public Prosecutor.

Listing the matter for compliance on December 9, 2026, the Bench ordered, “We again direct the respondent to appear in person before this Court on the next date of hearing.”
