The Supreme Court today refused to entertain a Writ Petition seeking contempt action against BJP MP Nishikant Dubey over his alleged derogatory comments targeting the Apex Court and the Chief Justice of India.

A Bench of Chief Justice of India Sanjiv Khanna and Justice Sanjay Kumar remarked, "We will pass a short order... but we will not entertain it."

Advocate Vishal Tiwari, appearing in person, submitted, "...it is for the first time that... at least the dignity of this institution shall remain. It shall not go as if we are giving a clean chit."

He further contended, "Apart from this scandalising statement, it is also hateful and provocative. The law is there, at least... We have to stop it..."

The Court reassured Tiwari, "We will be passing a short order. But we will not entertain...but we will be expressing our views..."



Dubey had recently stirred controversy by claiming that the Supreme Court was “leading the country towards anarchy” and accusing Chief Justice Sanjiv Khanna of being responsible for "civil wars" erupting across the nation.

Pertinently, the SCAORA had passed a resolution condemning Dubey's speech. In the resolution, it was stated, "Such remarks are not only factually baseless and deeply irresponsible, but they also amount to a direct and unwarranted attack on the independence, dignity, and majesty of our country's highest Constitutional Court. These statements are defamatory in nature and seek, to lower the judiciary's authority in the eyes of the public."

"It is a fundamental tenet of our democracy that the judiciary remains independent and is respected as one of the key pillars of the Constitution. While individuals may have disagreements with particular judgments or orders of the courts, the expression of such disagreements must remain within the bounds of dignity, constitutional decorum, and legal propriety", it added.
