Eleven members of the Executive Committee (EC) of the Supreme Court Bar Association (SCBA) have written to its President Senior Advocate Kapil Sibal calling upon him to call a meeting of the Executive Committee within seven days.

The letter was written on Tuesday as no meeting of the EC had been called by Kapil Sibal since September 10, 2024.

The letter has been signed by a majority, eleven out of the twenty one members of the Executive Committee. The letter begins by stating that as per Rule 12 of the SCBA Rules, the Executive Committee shall ordinarily meet at least once every three months for the dispatch of business.

"The last meeting of the EC was held on 10.09.2024 and 5 months have since elapsed with no further meetings being called", the letter says.

The letter warns that if the EC meeting is not called by Sibal within seven days, the majority members will proceed to address all important and longstanding issues of the Bar as per Rules.

"We the undersigned Majority members of the Executive Committee, SCBA therefore request your good self to call a Meeting of the Executive Committee, Supreme Court Bar Association as per SCBA Rules to discuss important and longstanding issue of the bar within the next 7 days failing which the undersigned majority members will proceed to address all important and longstanding issues of the bar as per Rules", the letter says.

The letter has been signed by Joint Secretary Sandeep Singh, Treasurer Sasmita Tripathy, Senior Executive Members and Senior Advocates Shobha Gupta, Jayant Bhushan and Sonia Mathur, Executive Members Ashish Kumar Sinha, Anil C. Nishani, Shashank Shekhar, Yogamaya M.G., Rachna Gandhi and Vikas Bansal.

In November, last year, a member of the SCBA wrote to Kapil Sibal calling upon him to fulfil his election promise of a group insurance policy for SCBA members and their families.

Earlier, a letter was addressed to Kapil Sibal by the former President of SCBA, Dr. Adish C. Aggarwala raising concerns about Sibal’s alleged lack of support for the common interests of SCBA members. Senior Advocate Aggarwala criticized Sibal’s decision not to endorse a resolution that called for a boycott of the Supreme Court Museum’s inauguration that happened on November 7, 2024.

In August, last year, the members of the EC had written to Sibal after a resolution on the letterhead of the SCBA was put out, signed by Sibal, regarding the incident at the RG Kar Medical College and Hospital. The EC Members have alleged that the purported resolution was not even placed before the EC. Sibal was then appearing for the State of West Bengal in a suo moto case initiated by the Apex Court on the same incident.

Dr Adish Aggarwala then wrote to Sibal warning about a no-confidence motion against him, if he does not withdraw the said controversial 'resolution' of the SCBA.

In May 2024, Senior Advocate Pradeep Rai sought action against Sibal for attending an election campaign meeting in the Main Bar Room of the Punjab and Haryana High Court in Chandigarh in his capacity as the President of the SCBA.

When the SCBA election campaign was at its peak, a plea was filed by Advocate Kumud Lata Das before the Supreme Court for cancellation of the candidature of Senior Advocate Pradeep Rai for the post of President. Rai appeared before the Court and submitted that the plea was moved at the instance of Kapil Sibal. The Court refused to entertain the plea.
