The Supreme Court has dismissed a writ petition filed under Article 32 of the Constitution seeking an early hearing of a writ petition pending before the Allahabad High Court since 2021.

The Bench of Justice JK Maheshwari and Justice Aravind Kumar observed that no direction could be issued in such a petition under Article 32.

"In our view, no direction can be issued in the petition under Article 32 of the Constitution of India. Accordingly, the writ petition is dismissed," the Bench ordered.

The petitioner had approached the Supreme Court contending that despite a counter affidavit being filed in 2024, the writ petition remained pending before the High Court.

The Bench noted, "The present petition has been filed seeking earlier hearing of the writ petition pending since 2021 before the High Court of Judicature at Allahabad in which counter affidavit has been filed in 2024."

However, the Court declined to intervene, stating that it was open to the petitioner to approach the High Court with a request for an expedited hearing. "However, it is open to the petitioner to make a request before the High Court for early hearing," the Court noted while dismissing the petition.
