Allahabad HC Asks State And CBSE About Steps Taken For Controlling Running Of Coaching Institutes In School Or College Buildings
The Allahabad High Court while dealing with a plea has asked the Uttar Pradesh State Government and CBSE (Central Board of Secondary Education) about the steps being taken for controlling the running of coaching centres in the school or college buildings.
A Division Bench of Justice Mahesh Chandra Tripathi and Justice Prashant Kumar said, “Considering the facts and circumstances of the case, let response/counter be filed by the Secretary of the Department concerned as well as the Secretary, CBSE, New Delhi also apprising the steps being taken across the State for controlling such menace.”
The Bench has further directed that the said response/counter be filed within ten days.
Advocate Surendra Kumar Chaubey appeared for the petitioner while Addl. Standing Counsel Devesh Vikram and Advocate Hridai Narain Pandey appeared for the respondents.
In this case, a writ petition was preferred for a direction to the respondents to ensure the strict compliance of U.P. Coaching Regulation Act, 2002 and C.B.S.E. Circular within stipulated period. The petitioner was a member of trust named 'Janki Trust' and the said trust was constituted for charitable work as well as for running academic institution and was running the school affiliated by CBSE. The grievance of the petitioner was that in the vicinity of his institution there were various institutions affiliated by CBSE and running coaching institutes in the premises of school / college buildings.
As per the petitioner, the aforesaid act was contrary to the policy of CBSE as well as U.P. Coaching Regulation Act. In this regard, he made several representations to the authorities concerned but no action was taken. The counsel for the petitioner, in support of his submissions, placed reliance on the judgments in the cases of XL-IIT, Allahabad & Ors. v. State of U.P. & Ors., (2003) 3 UPLBEC 2067 and Smt. Punam Singh v. State of U.P. & Ors., (2013) 1 UPlBEC 371.
The High Court in the above context of the matter noted, “On the matter being taken up on 29.5.2023, learned Addl. Chief Standing Counsel was asked to seek instructions in the matter. Today Shri Devesh Vikram, learned Addl. Chief Standing Counsel states that adequate information has been sent to authorities concerned but till date he has not received instructions in the matter.”
Accordingly, the High Court has listed the matter for the next hearing on August 14, 2023.
