The Rajasthan High Court has come to the aid of a student with a 100% hearing impairment by directing that one interpreter, an extra hour and an extra copy be provided to her during the practical examination of Bachelor of Radiation Technology.

The Court further ordered that the paper prepared for students falling under the hearing impairment disability should be provided to the petitioner for taking the examination.

The Single Bench of Justice Anoop Kumar Dhand held, “It goes without saying that the paper prepared for students falling under the hearing impairment disability be provided to the petitioner for taking examination in accordance with the procedure followed by the respondent-University for the examinations of persons with disability under the category of deaf, dumb and blind person.”

Advocate Mahendra Shandilya represented the Petitioner while Advocate M.A. Khan represented the Respondent.

Factual Background

In an earlier order dated May 28, 2025, the respondent-University was directed to apprise the Court of the arrangements that could be made for the assistance of the petitioner for the preparation of her studies and preparation for the examination.

Arguments

It was brought to the Court’s notice that an Interpreter was provided to the petitioner, but the petitioner insisted on being taught at her home. It was the case of the respondent-University that such service of the interpreter couldn’t be permitted. It was submitted that the petitioner can take the help and services of the Interpreter in the College premises. It was further submitted that for practical examination, the Interpreter would be provided, but for theoretical examination, the assistance of the Interpreter was not required as the petitioner was not a visually impaired/blind person. It was the case of the Respondent that the petitioner has a hearing impairment, but she can see and write.

Directions

In light of the arguments put forward by the counsel for the respondent-University, the Bench ordered one Interpreter to be provided for the purpose of assistance in studies to the petitioner till her theory examination takes place in the college premises.

The Court also ordered that one Interpreter be provided to the petitioner for assistance in studies for practical papers and also to assist at the time of the practical examination. “Provide an extra hour and one extra copy to the petitioner during the course of theory as well as practical examination”, it directed.

The matter has now been listed on July 8, 2025.
