Mental Condition Of Youth Astonishing And Disturbing: Kerala High Court Grants Bail To Man Who Attacked Mother After Mother Supports Granting Bail

The Kerala High Court has expressed deep concern over the mindset of the younger generation, calling their mental condition “astonishing and disturbing” while granting bail to a 25-year-old man who brutally attacked his mother using a knife for refusing to give him money for New Year’s Eve celebrations.
The Court was hearing a bail application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. The petitioner was accused of offences punishable under Sections 118(1) and 109 of the Bharatiya Nyaya Sanhita (BNS), 2023. The mother filed an affidavit before the Court supporting the grant of bail.
The Single Bench of Justice P.V. Kunhikrishnan, while allowing the bail plea, remarked, “The mental condition of the youngsters of our country is astonishing and disturbing. For not paying money for celebrating New Year’s Eve, the petitioner attacked his own mother and inflicted serious injuries.”
Advocate Girish Kumar M.S appeared for the Petitioner, while Senior Public Prosecutor Noushad K.A. appeared for the Respondent.
The Court, however, noted that no purpose would be served by solely blaming the youth and emphasized the role of society and parents in closely monitoring and guiding them to ensure they build relationships with good people.
The Court granted bail only after the mother submitted an affidavit stating she had no objection to his release. The affidavit highlighted the unwavering love of a mother, with the woman stating that she could not bear to see her son behind bars.
Acknowledging the emotional and psychological impact on the mother, the Court observed that detaining the accused would only prolong her trauma. "This sentence contain the tears of this unfortunate mother. I am sure that the wounds on her body might not have been healed. But her love to her son over takes the wounds. Thinking the fate and trauma facing by the mother, I am forced to grant bail to the petitioner," the Bench said.
“A mother’s love is like a rose—it will bloom forever. There is no purpose in blaming the young generation. The society and parents should watch them closely and monitor that their relationship is with good people. No purpose will be served by retaining this youngster in detention to continue the trauma of his mother. He can be released on bail after imposing stringent conditions,” the Court said.
While granting bail, the Court imposed stringent conditions and directed that the mother could approach the jurisdictional police station if her son engaged in any criminal activity. The police, in such an event, would be entitled to seek the cancellation of his bail from the competent court.
