Perform Community Service, Deposit Rs 25k: Bombay HC Quashes FIR Registered Against Man Booked For Driving Motorcycle Without Helmet & License

The Bombay High Court quashed an FIR registered against a 22-yr-old man for driving a motorcycle without a helmet as well as a license and also asked him to perform community service at a Hospital for 4 Sundays.
The case was registered against the Petitioner when he was 17 years old. The High Court was considering a Criminal Writ Petition instituted by the Petitioner seeking quashing of the case registered under sections 353, 332, 504, r/w 34 of the I.P.C. and other sections of Motor Vehicle Act.
The Division Bench comprising Justice Rajesh S. Patil and Justice Ravindra V. Ghuge noted, “The undertaking of the Petitioner No.1 is recorded that he will wear a helmet, whenever he rides a motorcycle in future, after receiving back his license.”

Factual Background
It was indicated in the FIR registered at the instance of the Respondent that after the Petitioners were stopped in a surprise random check, it was noticed that Petitioner No.1 was not wearing a helmet and did not have a driving license. He was 17 years of age at the time. The Petitioner’s mother had allegedly created a scene in the Police Station and was said to have touched the dress of the Police Constable and two buttons of the shirt were torn off.
Arguments
It was the case of the Petitioners that they have serious remorse and regret for the act that was committed. It was submitted that Petitioner No.1 was a minor who could not curb his impulses and the mother may have misbehaved in the heat of the moment as she thought that he would get in deep trouble. The Counsel also informed the Court that the Petitioner-mother was willing to donate an amount of Rs.25,000 and the Petitioner-son was willing to do Social Service as may be directed.
Reasoning
Considering the nature of the offence and keeping in view the law laid down in the case of Narinder Singh & Ors. V/s. State of Punjab & Anr., the Bench allowed the Writ Petition.
The Bench directed that Petitioner No.1 shall perform Community Service on four Sundays at S.K. Patil Mahanagarpalika General Hospital, Malad (E). The Bench also directed that his driving license would be retained by the SHO until April 15, 2025. Noting that an undertaking was given by the Petitioner saying that he will wear a helmet, whenever he rides a motorcycle in future, the Bench directed the mother to deposit Rs 25,000.
