The Gujarat High Court in a matter relating to the derecognition issue has allowed the Gujarat University to start the admission process for the students intending to join the three-year LL.B. course.

A Single Bench of Justice Nikhil S. Kariel said, “… this Court, as of now, permits the respondent no.3 University to start the admission process for students who are intending to join the Three Year LLB Course in the Institutions in question and whereas the students would be made aware about the fact in writing about the present petitions challenging the aspect of derecognition pending before this Court.”

Senior Advocates S.I. Nanavati and Prakash Jani appeared for the petitioners while Advocate General Kamal Trivedi, Government Pleader Manisha Lavkumar, and Assistant Government Pleader Jyoti Bhatt appeared for the State. Advocate Manan Shah appeared for the Bar Council of India (BCI) and Advocate Vikas Nair appeared for the Gujarat University.

In this case, three grant-in-aid colleges i.e., LA Shah Law College, IM Nanavati Law College, and MN Nanavati Law College, preferred pleas before the court contending that the BCI had removed them from the list of recognized law colleges without doing the mandatory inspections. Earlier, the court had stayed admissions in eight government grant-in-aid law colleges in the city and Gandhinagar.

The High Court in the above regard allowed admission saying, “Considering the submissions made by learned Counsels on all the sides and having regard to the fact that the learned Counsel on behalf of Bar Council of India is to suggest on the next date the list of members of the Apex Body of the Bar Council who would make it convenient to visit the State of Gujarat to hold meetings with the State Government for finding a way out of this impasse and further considering that the parties have been requested by the Court to try and find a way out and since parties are exploring a possible solution and also having regard to the fact that the University would be required to start the admission process at the earliest …”

Accordingly, the Court listed the matter for the next hearing on June 30, 2023.
