The Gujarat High Court has directed an investigation into a matter wherein the doctor was accused of having a criminal history and issuing medical certificates in the name of different hospitals.

A Single Bench of Justice M.K. Thakker observed, “Prima-facie, it transpires that the said doctor namely Mr. M.L.Patel (Mr. Mahendra L Patel) is issuing such bogus Certificates in the name of different hospitals with different addresses. … Let the certificate issued by Dr. M.L.Patel be verified and examined by concerned Investigating Officer under the supervision of the Commissioner of Police, Surat so that, correct and true facts be surfaced on record.”

Advocate Amit D. Shah appeared for the applicant while APP Bhargav Pandya appeared for the respondent.

In this case, two pleas were preferred by the prisoners seeking temporary bail on the ground of medical treatment. The Trial Court observed that a doctor was in the habit of issuing medical certificates in the name of different hospitals to aid the prisoners in filing applications for bail before the court of law.

Different addresses were mentioned in the different certificates and it was also revealed that the doctor had a criminal history. Various cases were registered against the said doctor for the offences punishable under the Motor Vehicles Act and Indian Penal Code.

The High Court in view of the above facts directed, “Registry is directed to send a copy of this order to the Commissioner of Police, Surat and learned Additional Public Prosecutor for onward communication. … Registry is also directed to place a copy of this order in connected matter.”

Accordingly, the Court listed the matter on June 8, 2023.
