"Clean Antecedents": Delhi High Court Grants Bail To Former Punjab AAG In NDPS Case

The Delhi High Court has granted bail to Vikramjit Singh, a lawyer and former Additional Advocate General (AAG) for the State of Punjab, in connection with a case registered under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985.
The Single Bench of Justice Jasmeet Singh observed that the twin conditions under Section 37 of the NDPS Act, which mandate reasonable grounds for believing the accused is not guilty and would not commit any offence if released, were satisfied in this case.
The Court noted that Singh had been in custody since February 26, 2024, and that the investigation was complete with the chargesheet already filed.

Court's Observation
However, the Court found no admissible evidence linking Singh directly to the contraband. It noted that the disclosure statement of the individual from whose house the drugs were recovered did not implicate Singh and was inadmissible under law.
“There is no telephonic or other link between the petitioner and the individual in question. Additionally, the NCB, for reasons best known to them, did not arrest the two individuals allegedly responsible for supplying the contraband,” the Court said.
Highlighting Singh's clean antecedents and professional standing, the Court observed, “I am of the view that there are no reasonable grounds to believe that the petitioner is guilty of the offence as alleged of. The petitioner has clean antecedents and has no prior involvement in any criminal activity. The petitioner is an Advocate by profession and was Additional Advocate General for the State of Punjab. I am of the view that the petitioner is not likely to commit any offence while on bail. The prosecutor has been given opportunity to oppose the bail and has been heard. Hence, the twin conditions given under section 37 of NDPS Act are satisfied.”
