The Delhi High Court has granted interim bail to an accused suffering from tuberculosis after his condition worsened due the pollution level in the city.

The Court was considering a Bail Application for the commission of offences punishable under Sections 363, 364A, 506, 120B and 34 of the Indian Penal Code, 1860.

The Bench of Justice Swarna Kanta Sharma held, "Considering the overall facts and circumstances of the case, this Court takes note of the fact that the applicant/accused is suffering from Tuberculosis, which is not disputed. This Court further notes that on earlier occasions also, the applicant was granted interim bail and he has never misused the liberty so granted to him. Accordingly, this Court is inclined to grant interim bail for a period of 15 days to the applicant herein, on his furnishing personal bond in the sum of Rs.15,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/Successor Court/Link Court/Duty Judge...."

The Applicant was represented by Advocate Ankaj Giri, while the Respondent was represented by Additional Public Prosecutor Manoj Pant.

The Counsel for the Applicant had submitted that the Applicant was granted interim bail on October 04, 2025 by the Trial Court as he was a patient of tuberculosis and was admitted in hospital for treatment and discharged on October 23, 2025 from the hospital. Further, his interim bail was extended.

It was contended that due to air pollution in Delhi, the applicant is not able to breathe properly and he had also fainted due to breathing problems.

The Court granted him interim bail with terms and conditions.

The Application was accordingly allowed.
