The Telangana High Court yesterday quashed an FIR registered against the Shri Ram Janmbhoomi Teerth Kshetra Trust, the Trust constructing and managing the Ram Temple in Ayodhya, for conducting a Shobha Yatra allegedly in violation of terms of permission.

An FIR was registered by the Market Police Station, Hyderabad District on December 29 last year under Sections 188, 290 and 341 read with Section 34 of the Indian Penal Code and Sections 21 and 76 of the City Police Act. The FIR claims that the Shobha Yatra caused nuisance and inconvenience to the public by obstructing the road and playing DJ in high volume.

The FIR had been registered against Nagar Samyojak of the Trust and Trust members, in addition to the BJP state General Secretary, DJ operator and others.

The Bench of Justice T. Madhavi Devi quashed the FIR by allowing the petition filed by one of the accused. Advocate Mahesh Raje appeared for the petitioner while the Public Prosecutor appeared for the State.

"Having regard to the contents of the complaint, this Court is satisfied that the provisions of the alleged offences are not applicable to this case, particularly Sections 290 and 341 IPC. In view of the same, the proceedings in Crime No.260 of 2023 on the file of the Market Police Station, Hyderabad District are quashed", the Court said in the order.

It was the contention of the petitioner that the contents of the complaint do not attract either the provisions of Sections 188, 290 and 341 IPC or the provisions of Sections 21 and 76 of the City Police Act. He submitted that permission was granted and the Shobha Yatra was conducted in accordance with the said permission, and that the allegations in the FIR are made without any basis.

The FIR also said that when the Police asked the BJP state General Secretary to stop the Shobha Yatra, he refused to do so.

The FIR was registered suo moto by the Police on the same date as the Shobha Yatra.
