The Andhra Pradesh High Court has allowed the Sri Aadi Varahi Shakti Temple Trust to organize celebration of “Aashada Gupta Varaahi Navaratrulu” at the disputed temple land.
The Court was considering a Writ Petition seeking suspension of proceedings undertaken by the Authorities under Section 164(1) BNSS directing the Petitioner not to enter into the land and prohibiting the entry and occupation of the disputed land.
The Single Bench of Justice Harinath N. ordered, "The impugned proceedings dated 16.06.2025 shall stand suspended till 06.07.2025. The 6th respondent shall extend necessary bundobust to the petitioner/Sri Aadi Varahi Shakti Temple Trust for performing the proposed “Aashada Gupta Varaahi Navaratrulu” from 26.06.2025 to 05.07.2025."
The Petitioner was represented by Advocate Pathi Siva Prasad while the Respondent was represented by Government Pleader.
Counsel for the Petitioner submitted that the Petitioner is looking after the activities of Sri Aadi Varahi Shakti Temple Trust which was constructed on land measuring 0.50 cents at Tiruchanur Village. It was further submitted that the said land was purchased by the 7th Respondent and his family members by an unregistered agreement sale deed the the entire sale consideration was passed to him at the time of execution.
It was further submitted that the Petitioner intends to conduct “Aashada Gupta Varaahi Navaratrulu” from June 26, 2025 to July 05, 2025 and has made a representation to the authorities (6th Respondent). However, the 5th Respondent issued proceedings under Section 164(1) BNSS and directed the Petitioner and the 7th Respondent not to enter into the land and prohibited the entry and occupation of the disputed land.
He thereby sought modification of the said proceedings to the extent that the Petitioner be allowed to carry out the festivities.
The Court, while allowing the plea, directed the Petitioner to cooperate with the authorities so that no law and order problem is created and clarified that the order would not be implied as conferring title over the property.
