Allahabad High Court Grants Bail To Alleged Al-Qaeda And Jamaat-Ul-Mujahideen Members Arrested Under UAPA
The Allahabad High Court was considering an Appeal against an order passed by the Special NIA Court whereby the bail of the present Appellant was rejected.

The Allahabad High Court has granted bail to an alleged operative of Al-Qaeda and Jamaat-Ul-Mujahideen Bangladesh placing reliance on similar relief granted to other alleged operatives.

The Division Bench of Justice Rajesh Singh Chauhan and Justice Abdhesh Kumar Chaudhary held, "Keeping in view the aforesaid facts and circumstances and also considering the principles of parity, we are of the view that the present appellant is entitled to be released on bail by setting aside the impugned order."
The Appellant was represented by Advocate Furkan Pathan, while the Respondent was represented by Government Advocate.
The case was registered under Sections 121-A and 123 of the Indian Penal Code and Sections 13, 18, 18-B, 20 and 38 of the Unlawful Activities (Prevention) Act.
Citing relief granted in similar cases, the Counsel for the Appellant contended that since the allegations against the Appellant are similar to the allegations of other co-accused persons who have been granted bail while setting aside the impugned orders passed in their cases, therefore, on the basis of principles of parity the present Criminal Appeal may be allowed and the impugned order may be set aside and the present Appellant may be enlarged on bail.
The Court accepted the contention and granted bail with directions to the Appellant to furnish a bail bond of ₹1,00,000/- with appropriate reliable sureties as may be decided by the Special Court.
He was also asked to surrender his passport, among other conditions.
The Application was accordingly disposed of.
