The Allahabad High Court has initiated proceedings against Registrar and Review Officer for converting one proceeding into another without its order.

The Court was considering an Appeal to this regard.

The single-bench of Justice Kshitij Shailendra observed, "The Court takes judicial notice of the report dated 19.11.2024 and finds that the explanation offered transgresses the judicial powers of this Court in a case when one or the proceeding is held to be non-maintainable by the Court but without there being any order of the Court, the office attempts to apply its own "wisdom" to convert one proceeding into another."

The Appellants were represented by Advocate Manish Kumar Jain.

The Court while issuing order for drawing of proceedings against the two delinquent Officers, observed:

"This Court also takes notice that Mr. Rakesh Kumar Singh, Assistant Registrar (Second Appeal) and Mr. Dibyanshu Kumar, Review Officer have taken the matter so lightly without understanding the gravity of the act done by them, as already noted in the previous order of this Court."

The Court also directed for the matter to be put up as fresh before appropriate Bench.
