The Allahabad High Court reserved its judgment on the Jauhar University Case, specifically addressing their Petition against the government's decision to revoke the land lease.

The Maulana Mohamad Ali Jauhar Trust obtained the campus under a 99-year lease during the Samajwadi Party government. The Trust argues that they were denied the opportunity to present their case before the lease cancellation orders were issued, contending that such actions violated the principles of natural justice.

The Bench headed by Acting Chief Justice Manoj Kumar Gupta and comprising Justice Kshitij Shailendra, recorded contentions of the parties and listed the matter for December 20, 2023.

Advocate Faiz Ahmad appeared for the Petitioner and Additional Advocate General Sudhanshu Srivastava appeared for the Respondents.

The Maulana Mohamad Ali Jauhar Trust had acquired the campus during the Samajwadi Party government on a 99-year lease. A Government Order was passed to take over the land and cancel the lease of Jauhar University in Rampur. However, the High Court had earlier denied relief on July 14, 2023. Thereafter, the Petitioners approached the Supreme Court which passed directions.

Pursuant to the Supreme Court’s directions in the case of Executive Committee, Maulana Mohamad Ali Jauhar Trust v State Of Uttar Pradesh & Ors [SLP (C) 45480/ 2023]. The Supreme Court had instructed the High Court to consider an interim application for urgent relief on its own merits expeditiously.

In response, the State submitted an affidavit, outlining that out of 1479 students at Rampur Public School during the 2022-23 academic session, 733 have been transferred to other branches of Rampur Public School. Additionally, 161 Class XII students have graduated, and the remaining 585 students have enrolled in different schools. A meeting with students and guardians on December 15, 2023, revealed no specific issues raised by the attendees. The affidavit also mentioned the establishment of a helpline desk, which has been made operational, with information communicated to students and parents.

The High Court reserved its judgements after recording the contentions of the parties.

Accordingly, the Court listed the matter for December 20, 2023.
