The Allahabad High Court directed its registry that no private photographs or any indecent photographs shall be accepted by it without leave of the Court.

The Court held this while hearing a criminal miscellaneous bail application which was filed after the applicants bail application was rejected by the lower Court.

The bench of Justice Ajay Bhanot observed, “Filing of photographs which depict private moments between the parties or indecent photographs invade the privacy of a persons and can also in cases proof to be a traumatic experience.”

Advocate P.K. Singh appeared for the Appellant and AGA-I Chandan Agarwal appeared for the Respondent.

The applicant, Pradumn Gond through his bail application prayed to be enlarged on bail in a case under Sections 376, 506 IPC and Section 67 of the Information Technology Act, 2000 which was rejected by the lower Court.

The Court stated that the arguments of the applicant were not satisfactorily refuted by the respondent.

The Court released the applicant on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court below.

However, the Court imposed certain conditions in the interest of Justice such as the applicant will not tamper with the evidence or influence any witness during the trial, he will appear before the trial court on the date fixed, unless personal presence is exempted and that the sureties should be fixed after due application of mind.
