The Allahabad High Court Bench of Justice Jayant Banerjee allowed the bail of Irfan booked under Sections 147, 148, 504, 307, 354, and 324 of IPC.

Mr. Rajesh Kumar Sharma and Mr. Abhas Sharma appeared for the Accused. Mr. Ashok Kumar Singh appeared for the Complainants.

The Prosecution alleged that when the Complainants were returning to their house while raising slogan of "Jai Sri Ram", the Accused's side started beating them.

However, the Counsel for the Accused contended that he was innocent and had been falsely implicated and that the Accused's side also received injuries.

Further, it was also argued by the Counsel for the Accused that no specific role was assigned to any of the Accused by the Complainants and only a general role was assigned to the Accused.

The Counsel also submitted that there was no apprehension that the Accused will flee from the course of law after being released on bail. The Counsel also argued that bail should be granted since the Accused was in jail since March 11, 2022, and the possibility of conclusion of the trial in the near future is very bleak.

Lastly, the Counsel submitted that it was a case of parity as the other co-Accused had already been granted bail.

Therefore, the Court allowed the bail application while holding that "Let the applicant- Irfan son of Abdul Raseed @ Rashid Shakeel be released on bail in the aforesaid case on his furnishing a personal bond of Rs. 50,000/ with two sureties each of the same amount to the satisfaction of the court", while imposing 4 additional conditions towards the interest of justice.
