The Bombay High Court has recalled its earlier order directing the listing of a defamation suit after 2046, where a litigant, who is almost 90, insisted on pursuing the suit. The High Court also observed that the ego fight between the parties at the fag end of their lives clogs the judicial system.

The High Court has now listed the matter on July 15, 2026, for further consideration.

The Single Bench of Justice Jitendra Jain ordered, “Delete lines 4 and 5 of paragraph 2 of the order dated 28 April 2026 and replace paragraph 3 with “List this matter on 15 July 2026 for further consideration.”

Advocate Swaraj Jadhav represented the Plaintiff while Advocate Pushkraj Deshpande represented the Respondent.

“This is one of the matters where the ego fight between the parties at their fag end of their life clogs the system, which prevents the Court from taking up the matters which really requires more priority”, the corrected order read.

The High Court took note of the fact that on an earlier occasion it had expressed that the suit could be worked out by tendering unconditional apology but still the plaintiff was adamant on continuing with the suit.
