'Motivated Petition': Bombay High Court Dismisses PIL Seeking Recovery Of Z+ Security Charges For RSS Chief

The PIL sought directions to respondent authorities to forthwith recover security charges from the RSS towards Z+ VVIP security, to comply with the judgment of the Supreme Court in Union of India v. Bikash Saha & Ors., 2022.

The Division Bench of Chief Justice Chandrashekhar and Justice Anil S. Kilor held, “We do not find any public interest involved in this writ petition marked as Public Interest Litigation. The petitioner does not disclose the source of information. He also does not state that he conducted sufficient research as required under the relevant Rules and seems to have rushed to the Court on the basis of a newspaper report at Annexure-A (page 19) of the paperbook. Quite apparently this Public Interest Litigation is a motivated petition and amounts to an abuse of the process of law.”

Advocate A. R. Ingole appeared for the Petitioner and Advocate K. N. Shukul appeared for the Respondents.

The petitioner contended that Z+ security cover must be based on a reasonable assessment of threat perception and that public money should not be spent on providing security to an organisation.

However, the Court observed that except stating that he is a citizen of India, the petitioner had not disclosed any details about himself. The Bench noted that he expressed concern regarding Z+ VVIP security provided to the RSS Sarsanghchalak.

The Court recorded that the petitioner had not disclosed the source of information and had not stated that he had conducted sufficient research as required under relevant rules. It also observed that the petition appeared to have been filed on the basis of a newspaper report.

Accordingly, the High Court dismissed the PIL.
