Delhi High Court Objects To Advocate Appearing In VC Hearing From Park, Requests Bars To Sensitize Members

The Delhi High Court highlighted that the Bar Association had not followed through with an earlier similar directive.

The Delhi High Court has taken exception to an Advocate appearing for Video Conference hearing from a park and requested the Bar Associations to sensitize its members on decorum during such appearances.

The Court was considering a Bail Application in FIR registered for offence under Sections 498A, 304B and 34 of the Indian Penal Code.

The Bench of Justice Girish Kathpalia observed, "...Despite repeated directions, certain sections of the Bar have failed to understand decorum of the Court. The facility of videoconferencing, which was started during Covid pandemic was extended in order to ensure that the counsel may appear through videoconferencing sitting in his/her office so that the counsel is spared of running around in different court complexes in Delhi. But this does not mean that the counsel would appear standing in a park...".

The Respondent was represented by Additional Public Prosecutor Nawal Kishore Jha.

The Court refused to mark the appearance of the Counsel for the Petitioner as a consequence of her behaviour.

"Earlier also, such directions were issued and sent to all Bar Associations across Delhi with the request to sensitize bar members. But it appears that the same has not been done," the Court noted, calling for sensitization of Lawyers making appearances through Video Conferencing.
