Uttarakhand High Court Directs District Magistrate To Look Into Retailer's Grievance On Protests Outside Licensed Liquor Shop
A license holder for retail sale of liquor had approached the Uttarakhand High Court, aggrieved by the demonstration carried out in front of his shop.
The Uttarakhand High Court has come to the aid of a licensed retailer by asking the District Magistrate, Nainital, to take action on the protests outside his liquor shop and pass necessary orders under law.
A license holder for retail sale of Indian-made foreign liquor had approached the High Court, aggrieved by the demonstration carried out in front of his liquor shop by certain persons. The petitioner claimed that his business was being adversely affected, and there was an apprehension of an untoward incident.
The Single Bench of Justice Manoj Kumar Tiwari ordered, “The writ petition is, accordingly, disposed of by directing the District Magistrate, Nainital to look into the grievance, as highlighted by petitioner in his representation and pass necessary order, as per law, within three weeks from date of presentation of such representation along with certified copy of this order.”
Advocate Bhupendra Singh Bora represented the Petitioner while Deputy Advocate General Yogesh Pandey represented the State.
The State Counsel brought it to the Court’s attention that adequate police protection was being provided to his shop in order to prevent any untoward incident.
It was brought to the Court’s notice that the petitioner had made a representation to the District Magistrate, Nainital, and he would make another representation. The petitioner also claimed that it is the duty of the State to protect retailers who have been granted a license.
The Bench thus disposed of the petition by directing the District Magistrate, Nainital, to look into the grievance and pass necessary orders.
