The Supreme Court has issued notice on a writ petition filed by TMC MP Abhishek Banerjee seeking an expeditious decision by Speaker Om Birla on petitions for disqualification of 20 rebel party MPs who have aligned themselves with the Nationalist Citizens Party of India (NCPI).

The court refused to issue notice to the office of the Lok Sabha Speaker and the secretary-general of the House after noting the submission of Solicitor General Tushar Mehta that he is there to represent them.

The Bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V Mohana ordered, "Issue Notice to Respondent Nos. 3 to 22. Learned Solicitor General is appearing for Respondent Nos. 1 and 2. Solicitor General shall have instructions from Respondent No. 1."


Senior Advocate Kalyan Bandopadhyay appeared for the Petitioner, while Solicitor General Tushar Mehta appeared for the Speaker of the Lok Sabha.

Mehta submitted, "I appear...I have some issues regarding issuance of notice to the Speaker. My Lord, I am here. I will be appearing. I'll file my appearance also. Kindly don't issue notice. I would inform your Lordships today itself and I'm informing that notices are issued by the Speaker."

To which Justice Bagchi said, "No, no, it is not a question of notices, Mr. Solicitor. It's a question of completion of the proceeding within a time...we do not intend to issue a notice, but to pass any order against a constitutional authority without giving the authority to respond is also..."

CJI Kant said, "Notice will have to be issued to these 19 respondents."

These MPs are: Kakori Ghosh Dastidar, Sudip Bandyopadhyay, Satabdi Roy, Prasun Banerjee, Rachna Banerjee, Jagadish Chandra Barma Basunia, Partha Bhowmick, Arup Chakraborty, Adhikari Deepak Dev, Sayani Ghosh, Bapi Haldar, Md Abu Taher Khan, Kalipada Saren Kherwal, Asit Kumar Mal, June Maliah, Mitali Bag, Khalilur Rahaman, Mala Roy, Sharmila Sarkar and Pathan Yusuf.

The Petitioner prayed, "a. Call for records of all pending disqualification petitions filed against Respondent No. 3 to 22 for voluntarily giving up the membership by conduct under 2(1) (a) of Xth Schedule petitions under Article 142 of Constitution of India, 1950 and decide the said disqualification petitions;...b. In the alternative, issue a writ of mandamus on Respondent No. 1 to decide on the application dated 18.06.2026 issued by Petitioner being the leader of the AITC legislature party in Lok Sabha within set time-frames as per law laid down by this Hon’ble Court in Kesham Meghachandra Singh vs. The Hon‘ble Speaker, Manipur Legislative Assembly, 2020 INSC 65"

Accordingly, the matter was listed for a further date.
