The Supreme Court has dismissed a Writ Petition preferred under Article 32 of the Constitution, which sought a court-monitored investigation by the Central Bureau of Investigation (CBI) into alleged incidents of horse-trading and corruption regarding the trust vote won by the Tamilaga Vettri Kazhagam (TVK) government in the Tamil Nadu Legislative Assembly.

The Court declined to entertain the Public Interest Litigation (PIL) instituted by one KK Ramesh. The Bench observed that the petition was founded entirely on casual and vague allegations, which were completely unsupported by any reliable or cogent material on record.

The Bench of Chief Justice Surya Kant and Justice V Mohana observed, "We have heard for considerable length. This writ petition is based on vague and casual allegations without any reliable material on record to substantiate the same. We see no ground to interfere."

Advocate CR Jaya Sukin appeared for the writ petitioner.

The Counsel submitted, "Everywhere the ruling parties are demolishing the democratic activities...Today, I am seriously saying, we are not living in a democratic country."

CJI Kant said, "Which ruling party are you talking? Ruling party keeps on changing."

Another counsel said, "TVK."

The counsel for the Petitioner submitted that five legislators had orchestrally tendered their resignations before the media, which were swiftly accepted by the Hon’ble Speaker, facilitating their immediate defection to the ruling dispensation within a matter of minutes.

He contended that such overt acts of horse-trading were destroying the democratic fabric of the nation through a dual strategy of massive monetary inducements, running into thousands of crores, and institutional coercion where non-compliant legislators were indirectly threatened with criminal prosecution and imprisonment.

Sukin said, "Kindly see what is happening. One state in East India, one state in middle India, the parties...MPs...are flying in charter flight...different chartered flights...Who arranges it? In Tamil Nadu, five MPs file a resignation in front of the media, within minutes they join the other party. Speaker calls the media, in front of the media, the resignation letter is submitted, announced and accepted. There is total horse trading. Totally corrupted, totally destroying the democratic activities. In this country every ruling party is destroying democratic activities by two ways. First they are giving money, 1000 crores, 2000 crores, and bargaining MPs and MLAs. If they don't come then they threaten indirectly. You and your children will be kept in jail."

The petitioner had prayed for a direction to initiate a CBI probe into allegations that astronomical sums of money were distributed to legislators of opposition parties, and that lucrative government contracts were promised in lieu of their support during the floor test. Furthermore, the petitioner sought ancillary relief for the imposition of President's Rule in the State of Tamil Nadu under Article 356 of the Constitution, pending the completion of the said investigation.

The Plea prayed, "to issue of Writ of Mandamus or any other appropriate Writ or Order or Direction to the Respondents No.1 to 3:- To CBI investigation of irregularities and corruption in trust vote of Tamil Nadu Legislative Assembly on May 13, 2026 and until the complete the investigation President Rule must be implemented in State of Tamil Nadu."

Accordingly, the Court dismissed the petition.
