Supreme Court Refuses To Extend Time Granted To Dheeraj Wadhawan For Surrender In Loan Scam Case

The Supreme Court directed the CBI and Jail authorities to take Wadhawan for weekly medical check-ups to AIIMS, Delhi.

The Supreme Court refused to extend the time granted to former DHFL promoter Dheeraj Wadhawan for surrendering in the multi-crore bank loan scam case.

Earlier, on August 05, 2025, the Supreme Court cancelled Wadhawan's bail and directed him to surrender within two weeks.

The Bench of Justice Sanjay Kumar and Justice Satish Chandran Sharma refused to extend the time granted for surrender and directed the CBI and Jail authorities concerned to ensure that Wadhawan will be taken to AIIMS every Saturday for routine checkup.

Senior Advocate Kapil Sibal, appearing on behalf of Wadhawan, submitted that he suffers from serious medical ailments.

As the Bench expressed its reservation regarding extension of time to surrender, Sibal referred to the report by AIIMS and said, "Kindly have a Board of AIIMS arranged. If they say, yes..."

Upon which Justice Kumar remarked that medical examination has already been done and such submission are merely ongoing.

Thereafter, Sibal again referred to the reports and highlighted the medical issues being suffered by Wadhawan. Sibal continued to insist that the reports of Doctors suggest that surgical intervention was required. However, Justice Kumar remarked, "You can go to Prison. They will take you to hospital whenever required."

Sibal requested that the Court may decide on the basis of Board of AIIMS decision once Wadhawan will surrender.

Justice Kumar said, "No, everytime when it's required, they take him."

On continued submission with regard to the medical issues faced by Wadhawan, Justice Kumar suggested that he can be taken to hospital for check-up every Saturday.

Subsequently, Justice Kumar recorded in the Order, "We are not inclined to extend the time for surrendering as sought by the Applicant. However, as started that he may require Medical attention on regular basis in the light of the reports submitted by AIIMS Hospital, we direct the CBI and Jail authorities concerned to ensure that the Applicant is taken...every Saturday morning...to Orthopaedic Department, AIIMS, New Delhi".

Such hospital visits will continue till the time Doctor suggests that Wadhawan does not require further medical assistance.

Accordingly, the matter was disposed of.

Background

The Wadhawan brothers -- Kapil and Dheeraj-- were arrested in this case in July 2022. 

The FIR was registered on a complaint made by the Union Bank of India, which alleged DHFL, the housing finance company's then chairman-cum-managing director Kapil Wadhawan, then director Dheeraj Wadhawan and other accused entered into a criminal conspiracy to cheat the consortium of 17 banks led by the Union Bank of India, and in pursuance of the criminal conspiracy, the accused and others induced the consortium to sanction huge loans aggregating Rs 42,871.42 crore. Much of the amount was allegedly siphoned off and misappropriated by alleged falsification of the books of the DHFL and dishonest default in repayment of legitimate dues of the consortium banks, the CBI claimed.
