Supreme Court To Dismiss Over 1000 Cases Filed Between 2014 To 2020 If Filing Defects Are Not Cured Within 4 Weeks
The Supreme Court in an order dated October 20th, has provided a last opportunity to the Advocates on Record to cure the defects of one thousand-odd cases that were filed before the Court between 2014 to 2020.
The Single Bench of Justice PS Narasimha noted that the defects were in the filing and the files were returned to the Advocates-on-Record for curing the defects and for refiling, however, the matters did not come back to the Registry after rectification of defects in spite of reminders having been sent to the Advocates.
The Bench noted, "These one thousand odd matters listed today were petitions filed before this Court from 2014 to 2020. As there were defects in the filing, the files were returned to the respective Advocateson-Record for curing the defects and for refiling. These matters have not come back to the Registry after rectification of defects inspite of reminders having been sent to the learned counsels."
The Court thus observed –
"As a last opportunity, we grant a further time of four weeks from today to cure the defects, failing which the cases shall stand dismissed without any further reference to the Court."
Further out of the total one thousand cases, the Court has allowed 23 Petitions to be withdrawn and has also directed the registry to re-notify 18 cases, after verification, if necessary.
