2011 Rape Case: Allahabad HC Grants Anticipatory Bail To Swami Chinmayanand Saraswati

The Allahabad High Court yesterday granted anticipatory bail to Swami Chinmayanand Saraswati in a 2011 rape case where a law student alleged that he raped her.

The accused filed an anticipatory bail application in connection to the offences punishable under Sections 376 and 506 of the Indian Penal Code.

A Single Bench of Justice Dinesh Kumar Singh said, “Considering the stand of the complainant and the State, this Court finds it appropriate that the interim order dated 19.12.2022 be confirmed and thus, the accused-applicant is admitted on anticipatory bail.”

The Bench further directed the accused to appear before the Trial Court concerned within one week.

Senior Advocates Anoop Trivedi, Abhinav Gaur, Ankit Shukla, and Chandra Prakash Pandey appeared on behalf of the accused while Additional Advocate General Manish Goyal and Additional Advocate General Mahesh Chandra appeared for the State.

The High Court confirmed the interim order dated December 19, 2022, for the protection of the accused in this case.

Earlier in this matter, the Court had granted interim anticipatory bail to Chinmayanand in December while noting that the State although opposed to the prayer for anticipatory bail it could not dispute the factual position with regard to the protection granted to him during the pendency of investigation and State Government's decision to withdraw the prosecution against him.

The High Court, therefore, directed the accused to submit a personal bond and two sureties each of the like amounts to the satisfaction of the court concerned, if he has already not submitted.

“… the concerned trial court shall release the accused-applicant on anticipatory bail application with any other conditions as it may deem fit in the facts and circumstances of the case”, the Court asserted.

Accordingly, the Court granted anticipatory bail to the accused.
