Krishna Janmabhoomi Case: Allahabad HC Directs Mathura Court To Decide Application For Injunction Within Four Months

The Allahabad High Court has directed the Civil Judge (Senior Division), Mathura to decide the applications filed by the Plaintiff in the Krishna Janmabhoomi Suit expeditiously, within four months.

Justice Salil Kumar Rai passed the order while disposing of a petition filed by Bhagwan Shri Krishna Virajman and another.

The grievance of the Petitioners was that their applications under Order 39, Rules 1 and 2 and under Order 4-A, Rule 1 of the Code of Civil Procedure, 1908 filed in Suit No. 152 of 2021 are not being decided by the trial court, i.e., the Civil Judge (Senior Division), Mathura.

Whereas, Order 39, Rules 1 and 2 deal with temporary injunctions in the suit,  Order 4-A, Rule 1 deals with consolidation of suit and proceedings.

Advocate Ramanand Gupta appeared for the Petitioners while Advocate Punit Kumar Gupta appeared for the Respondents, U.P. Sunni Central Waqf Board and others.

"The Civil Judge (Senior Division), Mathura is directed to decide the aforesaid applications expeditiously preferably within a period of four months from the date a certified copy of this order is produced before him and after giving an opportunity of hearing to the affected parties, in case there is no legal impediment in deciding the aforesaid applications", the Court ordered.

The Court has clarified that it has not expressed any opinion either regarding the maintainability of the case or the merits of claim made by the petitioner.
