Delhi High Court Directs MCD To Verify Certificate Of Vendor Seeking Permission To Continue With Her Stall At Footpath
The Delhi Court was considering a Writ Petition seeking direction to the Respondents to allow the Petitioner to peacefully vend at her designated spot pavement, on the footpath, MB road, near Saket metro station.
The Delhi High Court has directed the Municipal Corporation of Delhi to verify the certificate of the Vendor seeking permission to continue her stall at the footpath near Saket Metro Station.
The Court was considering a Writ Petition seeking direction to the Respondents to allow the Petitioner to peacefully vend at her designated spot, i.e. on the pavement, on the footpath, MB road, near Saket metro station, Gate No.-2, South Zone, Ward-S-71, New Delhi.
The Division bench of Justice Pratibha M. Singh and Justice Rajneesh Kumar Gupta observed, "...let the provisional CoV of the Petitioner be verified by the Respondents. If the Petitioner’s CoV is found to be genuine, he shall not be disturbed in his vending so long as he adheres to the terms and conditions of the CoV."
The Petitioner was represented by Advocate Aditya, while the Respondent was represented by Advocate Mansi Jain.
The Petitioner claimed that she is vending at the mentioned vending site and is permitted to sell fresh fruits, vegetables and other perishable items because she has a Certificate of Vending.
The Petition was accordingly disposed of with the above direction.
