Delhi High Court Sets Aside Bail Condition Requiring Accused To Share Location 24*7 Through Google With Investigating Officer

The Delhi High Court was considering a Petition seeking deletion of the bail condition of constant monitoring imposed on the Petitioner.

The Delhi High Court has set aside a bail condition imposed on an accused by the Trial Court, requiring him to share his location 24*7 through Google with the Investigating Officer.

The Court was considering a Petition seeking deletion of the bail condition of constant monitoring imposed on the Petitioner.

The Bench of Justice Vikas Mahajan held, "In view of the law exposited by the Honb’le Supreme Court in Frank Vitus (supra), this Court is of the view that the condition as noted above could not have been imposed by the learned Additional Judge while granting bail to the petitioner."

The Petitioner was represented by Senior Advocate Vikas Pahwa, while the Respondent was represented by Additional Public Prosecutor Tarang Srivastava.

The Senior Counsel, citing the Supreme Court's decision in Frank Vitus vs. Narcotics Control Bureau (2024) argued that such a condition cannot be a condition of bail.

The Court accepted the argument and cancelled the condition.

The Application was accordingly disposed of.
