Application Pending Since 2001 For Allotment Of Land For Kali Mandir: Delhi HC Directs Expeditious Disposal

The Delhi High Court recently directed the Land and Development Office to expeditiously decide upon the plea of one Minto Road Puja Samity seeking allotment of the land for the Kali Mandir pending since 2001.

A petition was filed by Minto Road Puja Samity seeking directions from the Court to direct the concerned authority to favorably consider its application for allotment of land which was pending since 15th February, 2001 in terms of the erstwhile land allotment policy.

Senior Advocate Chinmoy Pradip Sharma appearing for the petitioner-Minto Road Puja Samity submitted that a Kali Mandir was situated in 1940 on the land in question. It was further submitted that the petitioner has been organizing Durga Puja on the said land.

He further contended that the Petitioner had applied for allotment of the land for the Kali Mandir by its application in 2001 which was pending and that the authority had failed to take a decision on the application to date.

He prayed that he may be granted liberty to file a detailed representation/application before the concerned authority for fresh adjudication of the request of the petitioner for allotment of land. He also prayed to direct the concerned authority to decide the matter expeditiously.

Anil Soni, Standing Counsel, appearing on behalf of respondents didn't show any objection to the prayer made.

Accordingly, the Bench of Justice Chandra Dhari Singh directed the petitioner to file an appropriate detailed representation/application along with a copy of the writ petition before the concerned authority within two weeks.

The Court further directed the concerned authority to decide upon the same by way of passing a detailed and well-reasoned order in accordance with law expeditiously, within six months.
