Counsel Unable To Distinguish Order Sheet From Cause Title Is A Threat To Sanctity Of Institution: Calcutta HC Orders Disciplinary Action
The Calcutta High Court was considering a matter where the counsel for the applicants had tampered with the order sheet.
The Calcutta High Court has asked the Bar Council to take action against an advocate who tampered with an order sheet. The High Court held that a counsel who is unable to distinguish an order sheet of the Court from the cause title of the application is a threat to the discipline and sanctity of the institution and is also liable for professional misconduct.
The High Court was considering a matter where the counsel for the applicants/petitioners had incorporated the name of the alleged contemnor in the order sheet of the Court instead of the cause title of the application, thereby tampering with the order sheet.
The Single Bench of Justice Suvra Ghosh held, “The state of affairs is extremely shocking. A learned counsel who is not able to distinguish an order sheet of the Court from the cause title of the application is a threat to the discipline, dignity and sanctity of the institution. The conduct of the learned counsel persuades this Court to hold him liable for professional misconduct.”
"Learned Registrar General, High Court, Calcutta is requested to take up the issue with the Bar Council, West Bengal so that necessary step is taken by the Bar Council, against the learned counsel under the Advocates Act, 1961, in order to uphold the dignity, integrity, discipline and sanctity of the judicial institution”, it ordered.
Advocate Suvra Ghosh represented the Petitioner.
The Bench noted that in explaining the incorporation, the Counsel had feigned ignorance. The Bench held that the matter needed to be sternly dealt with by the Bar Council, West Bengal.
The Bench thus asked the Registrar General, High Court, Calcutta to take up the issue with the Bar Council in order to take necessary step against the counsel. “A copy of this order alongwith a copy of the order sheet tampered with by the learned counsel and copy of the order dated September 09, 2026 be sent to the learned Registrar General, High Court, Calcutta for taking necessary steps in this regard”, it directed.
