The Kerala High Court has dismissed a Writ Petition seeking a writ of quo-warranto challenging the appointment of Dr. K. Jayaprasad as Pro Vice-Chancellor of Central University. Dr. Jayaprasad, the Vice President of ‘Bharatiya Vichar Kendra’ is the first Pro Vice-Chancellor of Central University of Kerala. He has been serving in the Grade of Associate Professor at S.N.College, Kollam from the year 2006 and took up responsibility at Central University of Kerala with effect from in August, 2014.
Earlier, one Mr.Gokul L. from Kannur, Kerala had filed a similar Writ Petition (WP(c) No.16075/2018) challenging appointment of Dr. Jayaprasad as Associate Professor, as Professor and as the Pro Vice-Chancellor. The same was dismissed by the High Court by its judgment dated 16th July, 2018. Mr.Gokul had filed Special Leave Petition (26438/2018) before the Supreme Court, which was dismissed as withdrawn on 12th August, 2018.
Despite the rejection of the first challenge against appointment of Dr. Jayaprasad, the present Writ Petition (WP(c) No. 10643/2019) was filed by one Mr.Dinesh Kumar P.V. who is serving as a Higher Secondary School Teacher in Kasaragode District of Kerala. After hearing the Senior Advocate for the Petitioner and Mr.V.Sajith Kumar, Standing Counsel for the Central University of Kerala, the High Court held by its judgment dated 17th June, 2019 that there was no challenge to the appointment of Dr. K. Jayaprasad when he was appointed in the lower post of Associate Professor and on his appointment as Professor and that in the absence of such a challenge it has to be assumed that he has been appointed legally to those posts. The Hon’ble High Court dismissed the Writ Petition which had similar pleadings as the earlier one and was filed on the same cause of action.
